What is personal data?

The meaning of “personal data” is defined in the General Data Protection Regulation (GDPR). According to the new regulation, personal data includes all information that refers to an identified or identifiable natural person. This can include for example, your rightful name, your address, your telephone number or your date of birth. Even information on how you can use this or other websites may contain personal data.

Providing the website

An access log through our webserver has been fully deactivated. But our system does use certain security plugins from WordPress which protect our website from attack and misuse. Normal, non-damaging website accesses are usually not logged by the plugins. However, as soon as there is the suspicion that our system is subject to an attack, data relating to the visitor’s computer system are automatically logged for forensic purposes and stored in firewall logs. The data stored includes the IP address, the data and time, the browser user agent and the reason for the suspicious activity.

Purpose of the processing
The capturing of logfiles serves to record averted or damaging website attacks, to secure forensic activities and to secure and stabilize our website.

Legal basis
The legal basis for this is Article 6.1(f) GDPR.

Legitimate interests
The purposes mentioned also include the legitimate interests in data processing within the meaning of Article 6.1(f) GDPR.

Data storage – duration
Data is deleted when it is no longer necessary to achieve the purpose for which it was captured. As a rule, this is the case after one month at the latest.

Objection
If data is captured in the extent described, this has become necessary to secure and to operate the website. There is, therefore, no opportunity to raise objection.

Legal basis for collecting and processing personal data

As soon as we have your consent to process personal data, Article 6.1(a) GDPR serves as the legal basis for processing your personal data.

When processing your personal data to perform a contract between you and intersoft consulting services AG, Article 6.1(b) GDPR serves as the legal basis. This also applies to processes required to conduct pre-contractual activities.

When processing personal data to perform a legal obligation to which our companies is subject, Article 6.1(c) GDPR serves as the legal basis.

Article 6.1(f) GDPR provides the legal basis for processing when the processing is necessary for the purposes of the legitimate interests pursued by our company or by a third party and where such interests are not overridden by the interests or fundamental rights and freedoms of the data subject.

Data storage – duration

Your personal data will be deleted or the processing will be restricted as soon as the data has met the purpose for which it was stored. Storage of the data beyond this may be possible if this is stipulated by European or national legislators in EU directives, laws or other regulations to which the controller is subject. The data will be deleted or its processing will be restricted when a prescribed deadline expires, unless it is necessary to continue storing the data to conclude or perform a contract.

Cookies

Cookies are small text files that are stored on your computer when you visit our website and allow us to reassign your browser.  Cookies store information such as your language setting, the duration of your visit to our website or the information you enter there.

There are different types of cookies. Session cookies are temporary cookies that are stored in the user’s Internet browser until the browser window is closed and the session cookies are deleted. Permanent or persistent cookies are used for repeated visits and stored in the user’s browser for a predefined time. First-party cookies are set by the website the user visits.   • MUIDB: Persistent third-party cookie used to link data from the Bing Advertising Network to other actions on the website. The storage period is 1 year.
  • _uetsid: Persistent third party cookie for the purpose of analyzing user activity on our website. The storage period is 30 minutes.

Google Tag Manager

We use the Google Tag Manager. Through this service we can manage our website tags. Tags are small code elements on our website that help us to improve our website. Which tags we use and which data we process with these tags for which purposes can be found in the following sections of our data privacy policy. No personal data is processed by the Tag Manager itself. If you deactivate the individual tags, the Tag Manager takes this into account.

Google Analytics

This website is using Google Analytics, a web analysis service of Google LLC (“Google”) is used on this website. The use includes the “Universal Analytics” operating mode. This makes it possible to assign data, sessions and interactions across multiple devices to a pseudonymous user ID and thus analyze a user’s activities across devices.

Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users interact with the site. The information generated by the cookie relating to your use of this website is usually transferred to a Google server in the USA and stored there. However, if IP anonymisation is activated on this website, Google will reduce your IP address within Member States of the European Union or in other states party to the Agreement on the European Economic Area beforehand. Data storage – duration
The data sent by us and linked to cookies, user-identifiers (e.g. User IDs) or advertising-identifiers are automatically deleted after 14 months. Data whose retention period has been reached is automatically deleted once a month.

Objection
You can prevent the storage of cookies at any time by adjusting your browser software accordingly; however, we would like to point out that in this case you may not be able to use all functions of this website to their full extent. You can also prevent Google from collecting the data generated by the cookie and relating to your use of the website (including your IP address) and from processing this data by downloading and installing the browser add-on. Google AdWords / DoubleClick and Conversion Tracking

Google AdWords help us combine our ads with certain search items. These ads can then be inserted when search queries on websites that are part of the Google advertising network are entered. Alongside this, we use AdWords Remarketing Lists for search ads. This allows us to customize search ad campaigns for users who have visited our site before.  The services allow us to combine our ads with certain search terms or to place ads for previous visitors in which, for example, services that visitors have viewed on our website are advertised. For interest-based offers, it is necessary to analyze online user behaviour.   Google uses cookies to perform this analysis.  When you click on an ad or visit our website, Google sets a cookie on your computer. This information is used to specifically address the visitor during a later search query. This is usually done by sending a “DoubleClick” cookie to the browser when a user calls up a page with DoubleClick ads. Information on the DoubleClick cookie technology used can be found here. With the help of this technology, both Google and we, as customers, receive information that a user has clicked on an ad and has been redirected to our websites to contact us via the contact form. Information obtained in this way is used exclusively in statistical evaluations to optimize advertising.  We do not receive any information that personally identifies visitors. The statistics provided to us by Google include the total number of users who clicked on one of our ads and, if applicable, whether they were forwarded to a page of our website with a conversion tag. On the basis of these statistics, we can identify which search terms led to our advertisement being clicked particularly often and which advertisements lead to user contact via the contact form.

We place Google AdWords ads and use Google Conversion Tracking to draw your attention to our current projects and developments, planned activities and services. In the Google advertising network, our ads are distributed to topic-related search results and websites using keywords we have defined.

Our legitimate interest lies in placing ads that you might find interesting, in making our website more interesting for you and achieving a fair calculation of advertising costs.

Objection
If you do not want your visit to be included in user statistics, you can avoid this by deactivating the storage option for cookies required for this technology and/or by changing your browser settings. Using Advertising Settings, you also have the option of selecting the types of Google ads and of deactivating interest-based ads on Google. Alternatively, you can deactivate the use of third-party cookies by retrieving the Deactivation Help from the Network Advertising Initiative. However, Google and we will continue to receive statistical information on how many users visited this site and when. Bing Ads und Conversion Tracking

In addition to Google Adwords, we also place Bing Ads to draw attention to our services, (a service of Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA). These ads appear in the Bing, Yahoo! and MSN search engines after searches are made via the Yahoo!-Bing network. We also have the possibility of combining our ads with certain search terms and are therefore present on all major search engines.

To conduct an analysis of user behaviour, Bing Ads also uses cookies. When you click on an ad or visit our website, Bing Ads stores a cookie on the user’s computer. This information is used to specifically address the visitor during a later search query. You can find more information in Microsoft’s Privacy Statement and in the Guidelines on Data Security and Privacy Statement.

In addition, we use Bing Ads Conversion Tracking as part of Bing Ads to display interest-based advertising. This requires an analysis of user behaviour. The only information we receive from Bing is that a user clicked on an ad and was redirected to our websites.  The information obtained in this way is used exclusively for statistical evaluations to optimize advertising. So-called social bookmarks (e.g. from Facebook, Twitter and Xing) have been integrated on our website. Social bookmarks are internet bookmarks that allow users of such services to collect links and news messages. These are only included on our website as a link to the corresponding services. After clicking on the integrated graphic you will be forwarded to the page of the respective provider, i.e. only then will user information be transferred to the respective provider. Contact

We also collect your personal data when you yourself give your approval to do so – for example when you want us to contact you. Of course, personal data transferred in this manner is solely used for the purpose intended: establishing contact.

These details are provided voluntarily and, in these cases, are initiated by you yourself. Provided the details supplied are details of communication channels (such as email address, phone number), we will use these channels to contact you to deal with your concerns.

Objection
You can refer to our data protection officer at any time with respect to deleting the data to your query (see below for contact details). However, this might also mean that we cannot fully deal with your concern.

Career

You can apply to our company electronically. Please note that unencrypted emails sent are not protected against third-party access. Therefore, to secure your data we offer you the option of downloading our public key and of encrypting your email together with your application documents.

Your details are used solely to process your application and in reaching a decision on an employment relationship.

Provided an employment relationship is established between you and ourselves, pursuant to Article 26.1 of the German Federal Data Protection Act, we can further process the personal data we have already received from you for the purpose of the employment relationship, if this is necessary to carry out the employment relationship.

Purpose of the processing
Data is gathered for the purpose of processing your application and in justifying any future employment relationship.

Legal basis
The legal basis for this can be found in § 26.1 German Federal Data Protection Act in connection with § 8.2 German Federal Data Protection Act. If you should consent to us storing your data for a longer period of time in order to take your application into consideration at a later point in time, Article 6.1(a) GDPR serves as the legal basis. Your personal data may be continued to be processes if this becomes necessary to defend against legal claims asserted from the application procedure. The legal basis in the event of this can be found in Article 6.1(f) GDPR. There will also be a legitimate interest in processing your data should we need to defend ourselves against any legal claims arising from the application procedure.

Data storage – duration
Personal data is deleted no later than six months after the conclusion of the application proceedings, unless you have given us your express consent to store your data for a longer period of time.

Transferring Data to Third Parties

We generally do not transmit your data to third parties, unless we are legally obliged to do so. Should external service providers come into contact with your personal data, we shall have made use of legal, technical and organisational measures and regular monitoring to ensure that such persons comply with the relevant data protection regulations. Furthermore, these service providers may only use your data in accordance with our mandate.

Your Rights

Gladly we will inform you whether and which of your personal data is processed by us and for what purposes (Article 15 of the GDPR). Furthermore, given the respective legal conditions, you have to the right to rectification (Article 16 GDPR), the right to restrict processing (Article 18 GDPR), the right to erasure (Article 17 GDPR), the right to object (Article 21 GDPS) and the right to data portability (Article 20 GDPR).

Irrespective of these rights and the possibility of asserting another administrative or legal redress, you also have the possibility at any time of asserting your right to complain to a supervisory authority, in particular, in the member state of your place of domicile, of your place of work or of the location of the alleged infringement if you are of the view that the processing of personal data affecting you infringes legal data protection regulations (Article 77 GDPR).
